Shenzhen is one of the most developed cities in China, with a thriving business community. In order to support this growth, the local government has developed a comprehensive system for companies to register, establish a presence and pay taxes in the city. In this article, we will look at the requirements for companies to establish a tax presence in Shenzhen and the steps needed to navigate the process.

To start with, the conditions for companies to establish a tax presence in Shenzhen in 2023 are quite stringent. The applicant must meet the following criteria:

1. The legal representative or responsible person of an enterprise who has accumulated a tax payment of over 3 million yuan for the past three years.

2. Solo business owners who have accumulated a tax payment of over 600,000 yuan for the past three years, or natural shareholder(s) of limited liability companies or partnership(s) with a proportionate investment in the actual paid-in capital of the enterprise that have accumulated a tax payment of over 600,000 yuan for the past three years.

3. Individual business operators who have accumulated a tax payment of over 300,000 yuan for the past three years.

4. Individuals who have legally earned and paid personal income taxes in Shenzhen, with a total amount of over 240,000 yuan.

Moreover, the applicant must be less than 50 years old. If the tax payments exceed the limit by one times or more, the age limit can be relaxed to under 55 years old but not including 55. The applicant must have been employed in the same enterprise (i.e., with the same Unified Social Credit Code) for the past three years and held the same position during this period, except for legal and eligible employment. There should also be no record of participation in any banned organization or activity by the applicant.

To apply for a tax presence in Shenzhen, you must provide the following documents: proof of tax payment, screenshots of the company and shareholder information from the Industry and Commerce Bureau with a seal, ID card, household registration book, and marriage certificate (if applicable). The processing time for this application takes around one to two months.

Establishing a tax presence in Shenzhen is a crucial step for growing businesses in China. By understanding the requirements and submitting the necessary documents, companies can quickly establish a tax presence and take advantage of the significant business opportunities that Shenzhen has to offer. It is essential for businesses to remain compliant with tax laws and submit all necessary paperwork on time to avoid any penalties or legal issues in the future.
